Note for visa expired applicants

If your visa expired recently and if you got missed to apply for a visa, your onshore new application will say something like this on a photo-note if you managed to apply within 28 days of your visa expired date. Regardless, you are given a 28 days time to reapply for the visa and have the new application considered. However, the process won’t be less rigorous than regular applications. Generally, visa expires from the midnight of your visa expiry date. However, it is important to see what is implied on yours. Compared to generally processed applications, you are highly unlikely to get a bridging visa instantly or the one auto generated by Australian Immigration System. Your application will be personally assessed by a case officer to grant you a bridging visa. This could take few days or even more depending on your case. Your application to new visa within 28 days will allow you to live lawfully in Australia, however your restrictions and accessibility to many things becomes difficult. (For example: loosing a shift on your job cause of VISA-NOT-PROVIDED reason) Crossing the 28-days grace period will automatically make you an unlawful international resident in Australia. In this case, you have to apply for a temporary visa that will allow you few days to prepare for an exit from Australia. New Visa Grant of your application is possible but not guaranteed as it depends on applicant’s case.

Again, as mentioned on news release of 2nd September 2020, these lists are also to be prioritized based from Employer Sponsored Applications and PMSOL lists. This list is issued in interest of Australian Labor Market and are to remain for temporary indefinite time.

Skilled Independent Migration (Based on Points)

  1. Study:

To all newcomers who are intending for permanent residency in Australia, you have two options; either apply through the experience and knowledge you gain onshore or do it through offshore experience. By studying you could claim up to 50 points. Suppose if you are applying for Visa Subclass-189 category, below number of points you will achieve from each activity.

2. Experience

Experience is another important aspect in migration process. Please note points for experience is only counted if your job is related with your study occupation and that comes with minimum set of duties and responsibilities you should carry out whilst at your job. Amount of experience earned within Australia has difference from experience earned outside Australia. See table below to get more clarification on experience.

3. Age

Count your points through the age calculator. Different aged groups are granted different amount of points. See below table to check where you stand.

4. Professional Year

This is a program designed for International graduates from Australian education provider to give them a real-life Australian work experience. In general, this is almost 1-year program that involve lectures or class work and work placement (internship) at the end. To be eligible for the award of these points your Professional Year must have your qualification completed in Accounting, ICT/Computing or Engineering, and in your nominated occupation or a closely related occupation. You need to find relevant authority to assess this program which is different for each occupation. This accreditation is valid for four years only and gives you 5 points towards Skilled Migration. This can only be done when you are on visa with full-time working rights. Also, most of the providers look for at least 1 year period in such kind of visa before you start or enrol on the course.

5. English Language Ability

Points for English Language ability can be achieved by giving an English test from test providers such as IELTS, TOEFL, PTE, OET and Cambridge Advanced Test. This accreditation is valid for 3 years from the date of test given.

6. Accreditation in a Community Language

This is also referred as NAATI or CCL these days. If you have an ability to speak second language other than English, you can sit for a test to prove an interpreter skill of your second language into English language. This gives you additional 5 points towards skilled migration. This is pretty much available for all major languages. This accreditation is also valid for four years.

7. Partner Skill

This provides up to additional 10 points upon meeting all the requirements from your spouse or de-facto partner. The requirements are set on their English Language Ability, Age and Skills they have. S/he must not be an Australian permanent resident or an Australian citizen.  Additionally, you will need to provide evidence that when you were invited to apply for this visa that they were under 45 years old.

Migration in Australia

Migration is not an easy decision to make. However, if you are intending to migrate Australia on a skilled visa, it is also not that tough as long as you fulfill the criteria. Obviously, it’s not that easy too since there are many lined up for the process and you might have to face a tough or mild competition depending on your occupation type. Here are basic things we would like to talk about Skilled Migration process in Australia.

These things should be kept in mind if you have recently arrived in Australia and are intending to migrate here permanently. Likewise a Green Card in United States, government here calls it Permanent Residency for those who are granted a visa to stay and remain in Australia for indefinite time. However, this also comes with few terms and condition which is not that difficult to fulfill as long as you intend to contribute on Australian economy.

You need to understand the basic words such as ceiling that refers to the word quota. The allocation for each occupation  is updated every new financial year. Other word of invitation means the number of invitations given for PR which does not reflect the number of invitations accepted by applicants.

  • Step One

  •  Step Two

Lodge your Expression of Interest (EOI) once you achieve your assessment from the relevant authority. EOIs are usually lodged from SkillSelect portal from Department of Home Affairs (DHA). You can do it by yourself however it is best advised to catch a Registered Migration Agent to avoid any errors in EOI. Please remember, once you receive a successful outcome of invitation from DHA and if it is found to have the information given wrong (mistakenly or intentionally), your invitation will be dismissed or cancelled and in a worst case scenario you could be penalised for submitting wrong information. It is best advised not to lodge multiple EOIs for same occupation. The system is designed to accept multiple application through single EOI for one occupation. For example, you could lodge Visa Subclasses 189, 190, 491, 188 and 132.

  •  Step Three

If you are applying for a state/territory nomination, you need to lodge your application separately for the State or Territory. This process is different from one state to another and has cost involved in it. Please find a suitable Registered Migration Agent (RMA) to know more in details for each state as it has completely different process for each state or territory. Each state has different requirements for you to qualify for PR pathway and it also depends on visa category.

  •  Step Four

If you are applying Skilled Nomination Visa and if positive outcome has been given for it, you may now proceed ahead with your visa application. Visa Application can be lodged in a web or paper-based documents. You may find a suitable RMA to help you with this process however this process can also be completed on your own. The important thing to notice is resulting in providing insufficient information and wrong information might get your application cancelled and you may not be eligible to apply for PR which means you will have to start another process again from Step 1 and this time the criteria could be different from the past.

  • Step Five

Wait for a visa outcome. Upon receiving successful outcome, you will now be eligible to stay in Australia for indefinite time by meeting the conditions imposed on your visa.

Study Humanitarian

Being armed with the knowledge and idea on importance of humanitarian studies is always a favorable part of Australian labor market. This area of study helps student to understand and apply the concept of academic and practical orientation towards the current scenario of humanitarian field, social work, development aid or emergency management. As cited from Charles Darwin University of Australia, this undergraduate study program provides students with essential knowledge, delivered by academics and practitioners, enabling students to develop the required skills to successfully address the needs of urban and rural communities with a focus on indigenous community work in Australia, especially the Northern Territory.

  • Humanitarian and Community Studies,
  • Humanitarian Aid and Development
    • Both falls under the classification of Society and Culture (broader field), Human Welfare Studies and Services (narrow field).

A bachelor program of this field would require the completion of Year 12 study or equivalent to it. For international student there is a requirement of proficient English, valid criminal history check and Working with Children Clearance for some universities as well just to ensure the students are prepared for the mandatory placement that would enable them to graduate. In general, this is a 3-year full-time course. As student emerges towards the end of this course, student builds expertise in the fields of indigenous knowledge, community development, community resilience, disaster risk reduction, project management and logistics. Depending on universities, colleges, and previous recognition of this unit, it could be completed from 3 to 4 years in a full-time basis or even less time.

A graduate of this program builds a foundation in a community service program, areas of human services, communication, and logistics job relevant to Australian regional and remote communities. Students could get their exposure in the governmental, non-governmental, various charity organisation, and other areas where community works are carried out. Not only this, successful completion of this degree makes it eligible to join the Australian Community Workers Association (ACWA).

Prospect for International Student – Visa and Migration

International Student upon successful completion of this study after remaining in Visa subclass 500 makes them eligible for post study work visa for one time only as other fields. The permanent residency pathway will also be open upon meeting the minimum requirements of the state for visa subclass 190 and 491. Student upon reaching the minimum criteria for visa application subclass 189 via skill select can open the pathway to permanent residency quiet conveniently as compared to other areas of study.
